Experience

Experience matters—especially in high-stakes, procedure-heavy disputes where strategy and briefing can decide the outcome.

Here are selected matters I’ve handled.

ERISA
RICO
NFL Player

I served as arbitration counsel for hundreds of DST employees pursuing ERISA claims through arbitrations.  I coordinated more than 550 individual arbitrations, pursued awards in federal court, and successfully led briefing and oral argument in the 2nd and 8th Circuits. The dispute was ultimately resolved through a global settlement.

I was retained by the heirs of Thomas Hart Benton to defend a retaliatory RICO lawsuit filed by UMB Bank after the heirs sued UMB in probate court.  I pursued a Rule 12(b)(6) dismissal strategy that defeated the claims in the Western District of Missouri. The Eighth Circuit later affirmed.

I represented NFL players in concussion-related suits against their former teams, asserting Missouri-law duties to provide a safe workplace and to warn of hidden dangers.  I briefed and argued remand and related jurisdictional issues, including arguments grounded in Missouri’s workers’ compensation framework. The dispute was ultimately resolved through settlement.

Results in your case will depend on the facts and law of the case.
